A Formal Demand for Retraction and Apology

PREAMBLE

This document serves as a formal request for corrective action following public statements issued by Chester County Commissioner Josh Maxwell that inaccurately characterized the lawful and necessary actions undertaken by the Republican Committee of Chester County in response to documented irregularities during the November 4, 2025 election. To protect public confidence in the electoral process, we submit the following findings and demands.

WHEREAS:

1. Chester County Voter Services failed to deploy proper poll books on November 4, 2025, resulting in more than 12,000 voters being required to cast provisional ballots;

2. Over 1,000 provisional ballot outer envelopes were discovered unsealed, compromising ballot security;

3. Such failures by Voter Services caused voter disenfranchisement before any ballot challenges occurred;

4. The Republican Committee lawfully challenged the compromised ballots as permitted by Pennsylvania election law;

5. Commissioner Maxwell publicly and inaccurately accused the Republican Committee of disenfranchising voters;

6. Commissioner Maxwell’s statements misrepresented the facts and politicized a nonpartisan issue;

7. The Phoenixville Republican Committee has standing in this matter due to participation in affected precincts and reliance on expert election-law guidance.

THEREFORE, the Phoenixville Republican Committee respectfully demands the following corrective actions:

1. Public Retraction

Commissioner Josh Maxwell shall issue a formal, written retraction published on all platforms where the original statements appeared and entered into the public record.

2. Public Apology

Commissioner Maxwell shall issue a formal apology directed to the Republican Committee, Paul G. Celentano, voters of Chester County, and all poll workers.

3. Oversight Commissioners Eric Roe and Marian Moskowitz, along with Solicitor Dolores Troiani, shall oversee the creation and enforcement of the retraction and apology.

4. Formal Censure

Commissioners Roe and Moskowitz shall publicly censure Commissioner Maxwell, enter the censure into the public record, and issue a press release.

CONSEQUENCES

Failure to take corrective action will further erode public trust in Chester County’s election administration. Should Commissioner Maxwell refuse to correct the record, resignation or formal removal proceedings should be pursued.

CONCLUSION

Election integrity is fundamental to public trust. Corrective action is necessary to restore transparency, accuracy, and confidence in Chester County’s electoral processes.
